HESPERIA • San Bernardino County Sheriff’s officials have launched an investigation to answer why it took about 40 minutes to dispatch a deputy to a home where a mother and daughter were savagely attacked in front of the victim’s two young children, authorities said Friday.

“There is currently an administrative investigation taking place to see what happened,” Cindy Bachman, spokeswoman for the sheriff’s department, said. “We’re concerned about the dispatch time.”

So when the staff at the San Bernardino County Sheriff’s Apple Valley station learned one of their longest-serving sergeants was ill, they rallied around him.

A few months ago, Sgt. Randy Gwaltney was feeling ill. After going to the doctor, he and his wife, Tammi Gwaltney received devastating news. He had stage 4 pancreatic cancer.

iePolitics: From a reader . . . murder by Sheriff’s deputies?

This was sent to me today:

I am writing to make you aware, if you are not already, of another Southern Californian who was killed by the police. On May 10th 2011 Allen Kephart of Crest Park CA (near Lake Arrowhead) died during a traffic stop after being slammed to the ground face down and repeatedly shot with a taser gun by at least 3 but as many as five cops. The San Bernardino Sheriff’s dept. says he ran a stop sign, then failed to pull over and then became combative with the deputy. Witnesses tell a different story. Witnesses also say that the police confiscated video footage. Allen was NOT in ANY WAY a criminal, nor was he ever at any time in his life violent. He was a law abiding, patriotic, and very active member of this community. That is something that NEVER happens.  I’m a night owl for one but also some of my health issues make mornings torture.  However, today I did not have a choice as there was something in town that required my attention.  I walked into Starbucks to set up shop.  My favorite seats were taken by a group of senior citizen males.  They looked familiar but their identities did not register and my still asleep brain.

iePolitics: More Explorer stuff

Here is another example of the way that the powers to be at the Sheriff’s Office rule as “Do as I say not as I do”. Captain Marhoffer was contacted and asked if some of his staff could assist at the past explorer academy with instruction of some of the classes. He stated that he would not allow any member of his staff to assist in any way with classes at the explorer academy. Well I guess two days later he shows up at the explorer academy in uniform and teaches a class on “Ethics”. Can you believe it. This is the same guy who was involved in the MDC issue and the same person who was dating an explorer when he was assigned to Rancho and taking her to the bar and drinking. Then to keep everything above board he married her. Now one must wonder why does the department have the problems they do with the explorer program. That would be like Hoops giving a class on no drinking or partying on county property and then having another party in the command post. Can you believe it.

Not sure how this one slipped past my informants, but it did. (Any chance this is the same guy as Yucaipa?  I heard that one was transferred to the jail.)   Thanks to the person who sent me the article from the Press Enterprise. Father says Gastineau preyed on 16-year-old girl in Explorers

A San Bernardino County sheriff’s deputy was arrested and placed on administrative leave late Friday, the same day the department received information he may have had sexual relations with a 16-year-old girl, according to a Sunday news release.

Nathan Gastineau, a 30-year-old Redlands resident and 1998 graduate of Redlands High School, was assigned to the sheriff’s Highland station, where he was a leader of the Explorers program.

The program gives law- enforcement training to students from 14 1/2 to 21 years old.

VVDP: Sheriff weighs suspension of more deputies

Editor’s Note:  This is the second in the series of stories related to the sex scandal in Victorville Sheriff’s Department 25 years ago.  This story ran in the Daily Press on February 21, 1986.  Note how similar former Sheriff Tidwell’s response to this scandal is to Sheriff Hoops’ response to the POST scandal.  Also of interest is that the crime that started this whole thing occurred on February 14.  The case was expected to be submitted to the district attorney just 11 days later.  Compare that to the POST scandal.

SAN BERNARDINO—At least two more of the Victorville station’s 43 street deputies will probably be suspended today by county Sheriff Floyd Tidwell, as an investigation into alleged sexual misconduct. continues.

So far, three deputies are under administrative leave, stripped of their badges and guns, and two have resigned.  Tidwell said this morning he anticipates “two more suspensions today, and possibly a third.”

The sheriff added that he is “devastated” by the events leading to his investigation of charges that the deputies had sexual relations with an Explorer Scout from the Victorville station before she turned 18 years of age, and that one raped her Feb. 14.

SBSun: Sheriff’s candidate wants grand jury to probe department — Originally posted 4-8-10

A candidate for sheriff criticized the Sheriff’s Department on Thursday and demanded a grand jury investigation, saying internal misconduct has been swept under the rug.

Deputy Mark Averbeck claimed high-ranking officials have been falsifying certifications that netted them extra pay.

When reached on his cell phone after Averbeck’s news conference, Sheriff Rod Hoops confirmed that an investigation has been ongoing since the allegations came to light in September and said charges may be coming. Continue reading

iePolitics: So why are there Brady cops anyway?

We’ve written articles on the subject of Brady cops just a time or two.  For those who do not know what they are, here is an excerpt from Wikipedia:

Brady v. Maryland, 373 U.S. 83 (1963) was a United States Supreme Court case in which the prosecution had withheld from the criminal defendant certain evidence. The defendant challenged his conviction, arguing it had been contrary to the Due Process Clause of the Fourteenth Amendment to the United States Constitution.

Police officers who have been dishonest are sometimes referred to as “Brady cops.” Because of the Brady ruling, prosecutors are required to notify defendants and their attorneys whenever a law enforcement official involved in their case has a sustained record for knowingly lying in an official capacity. Brady evidence also includes evidence material to credibility of a civilian witness, such as evidence of false statements by the witness or evidence that a witness was paid to act as an informant.

So, I ask, Why do Brady cops exist?  Seriously.  This goes back to my post earlier today.

iePolitics: Arrests expected Saturday

Multiple sources are telling iePolitics that the arrests in the POST scandal will be made on Saturday.  West Valley Detention Center is gearing up to receive those indicted and all arrested are expected to be booked and released.

We have also heard that the arrests could take place tomorrow, however, so far the original sources appear more credible.  We are guessing the defendants have already been told to report and doubt anyone will be ripped from the loving arms of their families.  We are betting it will be special treatment all the way. iePolitics: POST scandal update

As always, I will believe this when I see it but here is the latest scoop:

The indictments are expected to be announce March 7, 2011.  It is necessary to wait until that time to allow for the retirement or transfer of those involved.  I understand some transfers were announced Friday with more to come.  All individuals being indicted have been notified.

No one will be charged with felonies.  All charges will be misdemeanors.  Remember some of the thefts are in the tens of thousands of dollars.  Must be nice to have connections.

Examiner.com: Officials expected to be named in indictments involving P.O.S.T. scandal

The ethically-challenged San Bernardino County is expected to receive yet another black eye within a week or so.  Sheriff’s Department officials are accused of falsifying training records that were submitted to the Commission on Peace Officer Standards and Training (P.O.S.T.), resulting in tens of thousands of dollars being paid to each recipient that was not earned.

P.O.S.T. was created to set minimum selection and training standards for California law enforcement.  Certificates include basic, intermediate, advanced, supervisory, management, and executive.   Specialized certificates can also be awarded.  Each new level brings with it a raise in hourly pay.

iePolitics: Sheriff’s Deputy Chiefs

I’m hoping someone can clarify this for me.  I’m told the Sheriff’s Department gives its deputy chiefs a $1200 a month car allowance to buy their own vehicles.  However, the county pays for all gas, tires, insurance and upkeep on these vehicles, including gas for their families’ use, vacations, etc.  Can someone a) confirm this and b) explain why this isn’t double dipping?

iePolitics: Another questionable promotion

A female was promoted to lieutenant approximately six months ago and assigned to the jail.  This same female did the majority of her patrol time as a school resource officer assigned to Rancho Cucamonga.
When it came to being promoted to a detective, all of the sergeants at the time voted to give her a normal evaluation and not the evaluation for promotion.  Her immediate supervisors felt that she was not ready for promotion but when her evaluation went downtown the captain received a call from the chief who advised him that they were sending her evaluation back so that the captain could change it to a promotional evaluation “Because someone down here wants her promoted.”
Well she was promoted to detective and spent her time again in CAC.  Then she promoted to sergeant and now is a lieutenant.
She is assigned to West Valley Detention Center and is the lieutenant in charge of transportation, although she has never spent one day driving a transportation bus or van in her career.

iePolitics: Update on POST scandal

We now have confirmation from four separate sources that indictments are being issued in the POST scandal.  The only question is just how many and who exactly is involved.  I believe there may be some POBR and/or statute of limitations issues to be worked out.  We have been given numbers of expected indictments ranging from 15 to 30.  We also understand that indictments may reach the highest level of the Sheriff’s Department and may even involve other agencies.

For a change, this one is out of the valley and not the desert.  It seems a woman called the Sheriff’s Department to ask for a welfare check on her husband who was dispondant and she was not able to get a hold of him.  Two deputies were dispatched to the house.  They checked the grounds, looked in the windows, etc.  No one would answer the door.

We don’t know whether this is a result of the P.O.S.T. scandal or because of all the claims being filed against the county by the deputies in Needles, but they received word today that Captain Marinati is being reassigned downtown.  In recent months I cannot say that I have heard from every deputy assigned to Needles, but I bet I have heard from a majority of them.  Now I’m sure, many would like to see the lieutenant gone next.

VVDP: Sheriff’s workers rally around detective after medical nightmare

VICTORVILLE • Al Lobo has been a fixture in the San Bernardino County Sheriff’s Department for nearly two decades. He’s worked at several stations, in the Narcotics Detail and recently at the Victor Valley Jail.

Last April the detective began to feel sick. What many thought was only the flu turned out to be a medical nightmare for his friends and family.

After three weeks of being in a coma and having his heart stop more than a dozen times, an aggressive infection set in, forcing surgeons to amputate Lobo’s legs, one arm below the elbow and his hand at the knuckles, according to sheriff’s officials.

His fellow sheriff’s workers have rallied around him, according to Pam Hoffman, spokeswoman for the Adelanto station.

iePolitics: Our favorite twosome

Gina Perez and Chris Elvert are hot topics for the Department heads in SBSD (Chief of staff). You see Perez and Elvert have been making too many headlines in the iepolitics.com forum. Lets talk about how Perez and Elvert were dressed in full uniform during the “repo” session involving Perez’s personal vehicle and how Perez was acting like a “victim” but yet was ordering Hesperia deputies to arrest the Repomen who were doing their jobs.
The biggest question (time card fraud) is this – how was Perez getting paid by the county during her “Civil” interaction with this incident. Was she paid and on the county’s dime performing her personal business while in uniform?  If so why hasn’t there been an IA regarding such conduct? While performing this personal business she filled out a “citizen’s arrest form.”
There seems to be a huge conflict of interest here if you ask me! She also lied to deputies and the Hesperia Sergeant stating that her lock which was attached to her secured gate was broken or some how was picked open (which was verified that the lock had no damage or tampered with).
During her contact with the Hesperia Station Sergeant she argued and demanded that the repomen be arrested. The report was taken to satisfy Perez, (the victim). The D.A. received the report and did not file. Citing evidence that the repomen were within their rights and no crime was committed. It has been said that the repo company is expected to file a lawsuit against Perez for false arrest and other damages. I hope they sue you Gina…that is the least of what you deserve!
Elvert – since you are the all seeing eye of the Victorville Station, why in god’s green earth would you not stop some of this foolish behavior? You are the senior most ranking Sergeant and good friend to Gina….stop the madness. You would have been quick to burn a deputy over the same conduct. Elvert – get your station bitch in check.

iePolitics: Bad cop story update

We reported back in May of a serious traffic collision on Highway 395 where an off-duty Sheriff’s deputy, who was the daughter of a recently-retired lieutenant, hit a pedestrian.  She was under the influence of alcohol.  Here is the original story.

iePolitics: Another cop tidbit

My  old timers know that I once worked for the San Bernardino County Sheriff’s Department in Victorville.  I’m sure more recent readers find this hard to believe, but I actually liked most of the station brass.

I was the secretary to Captain Mike O’Rourke.  At that time of my hire we did not have a lieutenant, but when we did get one, Pat Klootwyk, is when I decided not all Sheriff’s brass was promoted because of their competence.

VVDailyPress:  Man to get probation for throwing puppy at train

VICTORVILLE • A Hesperia man who threw his 3-month-old puppy at a moving train in April has pleaded guilty but will likely only face probation.

Justin Joost, 27, pleaded guilty to one felony count of cruelty to an animal and admitted a prior prison term stemming from his 2005 vandalism conviction during a hearing Friday. He is scheduled to be sentenced Dec. 17 in Victorville Superior Court.

Joost applied for the mental health court earlier this month, but the court denied his request.

iePolitics: Coverup in Big Bear?

From an informant:

Over the past week, Big Bear has been searching for a missing person named Bryson Likacik. He was found friday a short distance from where he disappeared, dead in the snow. The first night when he went missing, the Dept refused to call search and rescue and didn’t start looking for him until Sunday, 2 days later. They refused to calll in search dogs so the family called in their own. Had they contacted search and rescue that night, he may have been found. Captain Garland is trying to cover the whole thing up once again.

iePolitics: Another bad cop story with serious consequences

Days ago an Amber Alert was issued for a 13-year-old girl, who was eventually found in Las Vegas in the company of a sex offender.   See Daily Press story.

This is a tragedy that could have easily been prevented.  You see, the defendant, Ivan Lopez, was seen in the neighborhood before the girl met up with him.  A neighbor thought his vehicle looked suspicious and called the San Bernardino County Sheriff’s Department.  A unit was dispatched to the scene and contact was made with Lopez.

The responding deputy ran Lopez for warrants and determined that there was at least one outstanding warrant for Penal Code section 288a, Oral Copulation:

iePolitics: It’s whom you know

Assistant Sheriff Pratt’s wife was involved in a hit-and-run traffic collision on a freeway off ramp in Victorville approximately six weeks ago and because of her current medical condition it was kissed off.   The funny part is that accidents that happen on the freeway and any part thereof should be investigated by the California Highway Patrol. This one was not.  It was done by Victorville Sheriff’s Station.

iePolitics: The Cop Chronicles

Despite a couple of complete Adam Henry’s from the SO who got on this site and have ticked me off tonight, I made a decision earlier today.  And I will abide by it.

On the days in which we post bad cop stories, our hits skyrocket.  These stories have been excellent for the blog.  We are enjoying a ten-fold increase of hits from law enforcement agencies around the country and just interested citizens from all over.  I guess it’s a super-mini version of a cops gone bad reality show.

Senor Blogger: Deputy misbehaving No. 1

This story involves a deputy that was assigned to SED/SWAT.  Unlike the supervisor assigned to this division, this guy really was a Navy Seal.  Seems like there are several stories about this guy and his anger problems.
One day he was traveling to Victorville in his county-issued unmarked unit. He felt that he needed to get there in a hurry and was traveling pretty fast in the fast lane.  Another driver would not get out of his way and he got upset.

Senor Blogger: Another Perez story

Sergeant Gina Perez was working patrol one evening as a watch commander.  There is another sergeant at the Victorville Station that adores his pit bull.  He has a picture of him and his pit bull on his desk . . . embarrassing (only to Senor Blogger). Perez’s deputies respond to a call and were attacked by a pit bull. They ended up shooting the dog because it was biting them and other subjects within the neighborhood.

iePolitics: What would you have done?

Almost two years ago I was approached by what turned out to be a panhandler in a Victorville parking lot one evening.  She was a middle-aged woman, dressed nicely, with a lengthy story to tell of breaking down on the freeway, walking to a nearby motel, and needing $9 and change so that her and her children could stay overnight until someone could get up the hill to rescue her.  She said the CHP had told her if they slept in the vehicle overnight, the Department of Children’s Services would be notified to take the children.  She said that the motel owner is threatening to kick them out if she didn’t come up with the money that evening.

iePolitics: Can you resend the emails?

I’ve lost two emails on Sheriff’s Department misdeeds.  Can you please resend them?

The first is on the deputy, out of Victorville I believe, who beat the crap out of a relative of a CHP officer.  There is more to the story but I can’t remember it. I believe it happened in the Cajon Pass and I believe this deputy was allowed to stay on patrol.

The second is the deputy who was caught with sticky fingers.  Unlike Captain Gray, he was charged with a felony.  Only difference is this deputy stole only hundreds of dollars, not thousands.  I believe he was fired but I’m not sure.

iePolitics: So that’s how it works in the Sheriff’s Department

There was a female deputy assigned to Rancho.  After getting off of probation she went to patrol for a short period of time and, when they figured out that she did not know what she was doing, but she was cute, they assigned her to be a School Resource Officer.
After a few years they noticed that she still “cute” so they thought they should get her out of a patrol station because she really does not know what she is doing and send her to the academy as a training officer.  You know to be a training officer you must look good in your uniform etc.

iePolitics: Sheriff Hoops steps in

Seems like San Bernardino County Sheriff Rod Hoops took matters into his own hands regarding the Narc in Palm Springs who beat up his tweaker girlfriend.   Hoops made a few calls the rumors are and last week the Riverside District Attorney’s Office refused to file charges on the narcotics officer.  The reason that was given:  mutual combat.  So, instead of dropping charges against the dick, why weren’t charges filed against both?  How amazing!

Whited: Sergeant Gina Perez: One hot mess after another…

We all know some Sergeant’s were never meant to be a sergeant; however those will probably never promote either. How does one like Gina Perez get to a job like this? 4 years as a “street cop” deputy working Victorville, then sent to the academy teaching “boots” how to “do their job” then thrust into Homicide where she told me it was, “all about my paper,” and now a screwball of a Sergeant conducting “Admins” without knowing what she is doing…least we mention all the policy, POBR, law enforcement code of ethics- violations she has done over the past 14 months.

Gina Perez you are incompetent, you have no integrity, no honor, and I have seen better leadership at a Boy Scout meeting. The county is losing money keeping her in this position.

We have been taken to task here at iePolitics for trashing the San Bernardino County Sheriff’s Department.  Of course, we are not the ones who drive drunk, beat their spouses, use illegal drugs on the job, get involved in hit and runs, steal money, etc., but it is still our fault for making the Sheriff’s Department look bad.  You have to understand that we do not write these stories to make them look bad; we write them to inform the public how their tax dollars are being wasted, how civilians are being put in danger by those sworn to serve and protect them, and how law enforcement officers exercise a different standard when one of their own breaks the law versus when a citizen breaks the law.

Today’s entry humorously refers to “hanky panky.”  It is not humorous at all.  Such on-the-job relationships are dangerous in more ways than one; sometimes deadly as the last story will show.  Here are our latest entries.

iePolitics: Another SBSD coverup?

Editor:  This particular email was sent to all the local papers and the chiefs of staff of all the members of the Board of Supervisors.  Since we have so many San Bernardino County Sheriff’s personnel reading the blog, I know you will vet it for me to determine its accuracy.

According to my sources, a scandal has recently emerged from within the ranks of the Honor Guard and from within the Public Affairs Division itself. The scandal involves the extramarital love affair between a female clerk working in the Public Affairs Division and a male Deputy Sheriff who coordinates the Honor Guard for the Department. He also works within the same office.  That Deputy, a twenty year veteran, has been married to his wife for over 30 years.  The clerk is married to a Sheriff’s Sergeant also on the department. The Deputy and the clerk had a secret affair then left their respective spouses while still married to embark on a relationship and new life together. They initially hid the affair from everyone including their spouses but ironically they ultimately informed their supervisors of it a few months later.

iePolitics: Well Supervisor Derry, ignoring the elephant in the room makes you as dirty as the rest of them

You know Neil, we try to defend you here at iePolitics most of the time.  But some things are beyond defensible.

For example, your comment that the POST scandal is a personnel matter.  It is NOT a personnel matter.  It is a FELONY matter that involved Sheriff Rod Hoops, former Sheriff Gary Penrod, and at least a couple dozen others ranging from clerical staff to deputy chiefs. It is misconduct of the worst kind by public officials and it is being swept under the rug with the tacit approval of the board of supervisors.

But it’s okay because you all endorse one another for election, donate to one another’s campaigns, and attend one another’s fundraisers.  We wouldn’t want justice to interfere with that, now would we?

iePolitics: Cop misdeed of the day – Part One

Today we are back to drunks instead of tweekers.  This is the second time around for this deputy.

Today’s San Bernardino County Sheriff’s Department employee is a deputy assigned to the Special Enforcement Detail (SED or SWAT).  The deputy may have been involved in an accident while driving drunk, but we cannot confirm that.

This same deputy was involved in a rollover DUI incident about two years ago in the Mentone/Greenspo area.  The California Highway Patrol responded to the crash.  They called the watch commander out of the Yucaipa station, who also responded.

iePolitics: Another drunk driving incident involving a Sheriff’s deputy

Incidents involving San Bernardino County Sheriff’s personnel and the special treatment they receive seem to never end.  The most recent incident involves a female deputy, who is still working patrol out of the Victorville Office and is in charge of the Explorer Scouts for that division.

This deputy was off duty and got drunk.  While trying to get on the freeway she missed the off ramp and her vehicle got hung up on the divider.  She began to move it back and forth to get it off the divider and ended up hitting another vehicle.

iePolitics: The Sheriff’s Department Email

I will be posting the email in its entirety soon.  It’s a tedious process that I don’t have time for now.  I do want to make a few points however.

I had three main reasons for starting this thread.

First, hostile work environment is a serious problem in San Bernardino County.  This email is hardly atypical of how those of a minority (sex, race, religion, sexual preference, economic status) are treated in the workplace.  Rather, it is quite common and those that complain are usually the ones that are punished.
