Examiner.com: Board of Supervisors declares war on police union; pays off with concessions

(San Bernardino) – Last week the San Bernardino County Board of Supervisors voted 3-2 to impose more than 14 percent in cuts on members of the Specialized Peace Officers Unit of the San Bernardino County Safety Employees Benefit Association (SEBA), the union representing sworn peace officers.  Supervisors Neil Derry and Brad Mitzelfelt voted against the measure.  Today, 73.5 percent of the unit’s membership voted to accept the arbitrator’s award they had previously rejected, thus avoiding the deep cuts.

“We’re proud of the Specialized Peace Officers for choosing the terms of their employment rather than settling for an imposed solution,” said Board of Supervisors Chair Josie Gonzales. “These public safety professionals have joined a growing number of county employee groups who have recognized the current economic realities and agreed to terms that will help avoid layoffs and allow the county to continue to provide an acceptable level of service.”  Supervisor Gonzales is one of the three county supervisors who voted in favor of imposing the cuts and who is under federal scrutiny in two FBI raids.

iePolitics: Will SEBA show some leadership now?

On a 3-2 vote, the San Bernardino County Board of Supervisors voted to impose salary and benefit reductions on the members of the Specialized Peace Officers Unit represented by SEBA.  Supervisors Brad Mitzelfelt and Neil Derry voted against the measure.

At issue is an evergreen clause that allows for the current contract to continue for one year until a successor contract  is negotiated.  As usual, the BOS believes it is above the law and does not have to honor its contractual obligations.  Now, we shall see if SEBA has backbone enough to fight for its members.  Certainly, it could seek judicial relief.  The question is, will they fight for their employees or back down like we have seem so often in recent years.

iePolitics: So where are you now James Mills, Charbie, LE Observer, Grunt and Taylor?

Some of you suggested I owed Beef an apology when we suggested he was not exactly being above board during the POST scandal, etc.  Hmm . . . so can you still say that Beef did not lie to all of you?  That he did what was best for SEBA members?  Or perhaps he cut a deal to take care of himself and screw all of you.  And he just about screwed you all over in a big way.  Fortunately, there are 23 members who saw through it.

Now I have a question for all SEBA members.  When you originally voted Beef in as SEBA president, did he tell you about his past and how he owed everything to Sheriff’s brass for even having a job?  I’m curious if rank-and-file who were not around in 1986 knew what they were voting for.

iePolitics: Deputies vote to turn down Devereaux’s generous offer

As indicated in a comment below and on the SEBA website, the lawsuit against SEBA was withdrawn and the votes were counted.  Fifty-five percent of the deputies eligible to vote cast a ballot.  I guess 45 percent don’t care what their paychecks look like it.  The measure lost.

Safety management voted to approve the contract concessions.  I do not know if they have a “me too” clause or not.  Maybe some can let us know.

iePolitics: So when are SBPEA members going to show some cajones too?

Does anyone really believe that SBPEA General Manager Bob Blough isn’t doing to SBPEA members behind the scenes exactly what Beef and now Laren were doing to SEBA members?  Yet SBPEA members do nothing but bend over and take it time and again.  I have long since given up on general county employees having an ounce of backbone.  I really believe they are getting exactly what they deserve.

I finally got internet access myself to try to sort this out.  I also cannot find a case in the court system.  The SEBA website, which seems to be lacking details on purpose, would suggest that the complaint was file with PERB, which does not explain information sent our way that a “judge ruled.”  I can only guess that wires got crossed but I don’t know that for sure.

iePolitics: SEBA president to be indicted? – Updated

iePolitics has told that a meet of the SEBA Board of Directors took place last night to replace current San Bernardino County Safety Employee Benefit Association (SEBA) president William “Beef” Abernathie.  The board was advised that Abernathie is among the 27 expected to have been indicted in the POST scandal.  Those indictments are expected to be unsealed next week.  Abernathie is also a sergeant with the San Bernardino County Sheriff’s Department.

InlandPolitics: Did Ramos consultant put clients in violation of campaign law?

Sources are telling InlandPolitics.com that the Orange County-based political consultant to San Bernardino County District Attorney Mike Ramos may have put his clients in violation of state campaign finance laws.

David Ellis, owner of Delta Partners, LLC and the David Ellis Group, is alleged to have put many of his clients in violation of what is known as the ‘sub-vendor rule’ in years prior to 2010.

Campaign committees are required to disclose any payment made to sub-vendors, who receive work outsourced by primary consultants and vendors.

Not until this year did Ellis have his clients, including a major local union, report all vendors receiving payments through his primary mail-house, Bieber Communications a.k.a Bieber McCraken.

Until 2010, Ellis reportedly received kick-backs on Bieber invoices of approximately 15-20% of printing costs charged to his clients. A practice believed to hide Ellis’ involvement in various political campaigns.

Any payments to sub-vendors in an amount greater than $500 are to be itemized on a clients campaign disclosure reports.

iePolitics: So Supervisor Derry, you’re a chicken – I thought you were a Marine!

You chickened out huh?  You know what I mean!  That’s okay.  Public airing of county issues is probably best anyway.

So, you did not provide me with an answer regarding the four bargaining units in SEBA. Of course, we all know the answer already.  And that answer shows my original premise was correct.  The county did in fact tell the unions how the vote would be conducted and what the outcome would be.   This wasn’t simply Bob Blough mouthing off, but an agreement between the county and the unions.

You can’t blame that on the unions.  Greg Devereaux and the Board of Supervisors are clearly at fault here.  You have an obligation when you know that the unions are not conducting elections lawfully to step in.  I’ve told you that; Jim has told you that. But because you liked the outcome and you know a legal election would not have the same outcome, you chose to look the other way.   And that makes you as crooked as the rest.

iePolitics: I would like a straight answer on this one Neil

Did or did not the BOS/CAO give all of SEBA their raises even if they voted to give up their raises.  And please don’t pile on the bullshit about layoffs and units and EMACs and all the rest.  You have a whole lot of people on this blog who have worked for HR and ACR and have been through layoffs a time or two.  We know how it works and what can and can’t be done.  There is NO legitimate excuse for giving raises to those who voted to decline them and not give them to all of us.

iePolitics: Question for SEBA and Attorneys Union members

Bob Blough, general manager of the San Bernardino Public Employees Association, has told his board of directors that although two units of SEBA voted to give up their raises, the county gave raises to all four units represented by SEBA.   Is this true?  How about the attorneys? Did you get your raises or not?

iePolitics: Supervisor Derry: Clarification and more examples

Supervisor Derry, since you have so graciously given up some of your Saturday night and Sunday morning to argue with me on the blog, I am going to give up my morning’s Frontierville play to try to explain to you the points I am trying to make.  As upset as I am about this, you are still iePolitics’ favorite supervisor. :)

As an elected official, elected to any office in California whatsoever, you have an obligation to uphold the Constitution of the State of California and the Constitution of the United States.  Hopefully, we both agree on that.

As an elected official, especially as a member of the governing body of the county of San Bernardino, we the public expect you to initiate an investigation when you have reason to suspect or personally witness unethical or illegal behavior by any person or entity under the purview of your jurisdiction.  That investigation may be as simple as referring the matter to Human Resources or as serious as referring it to the Grand Jury.  No one expects you to call in the Calvary for every act or suspected/alleged of malfeasance, but you are expected to at very least have someone in authority look at the situation to determine if there is any justification for further action.

iePolitics: How do we get rid of SEBA?

Various versions of this question are popping up on inland empire blogs.  If this question was being posed by SBPEA members I would not waste the keystrokes because there is not even one pair of testicles among the 17,000 members.  However, you guys have shown some backbone and I’m proud of you.  So, let me give you a little insight.  But I’m prefacing this with it is 10:30 at night, I am only vaguely familiar with your Memorandum of Understanding, and it has been a very long time since I read either the San Bernardino County Labor Relations Ordinance or Government Code Section 3500 et seq.  I cannot remember off of the top of my head if SEBA is covered under the Meyers-Milias-Brown Act or not, but I have little doubt if I’m wrong here, Erwin will let me know in the morning.

This is the way I see it.  SEBA is not the problem.  SEBA leadership IS the problem.  While Jim was president, he built a powerhouse union because he was more interested in building a powerhouse union than in becoming a lieutenant.  SEBA’s focus has changed and as I already said, that is a leadership problem, not a union problem.  There are a number of ways to address the problem.

The most drastic is, of course, decertifying SEBA, and forming a new union or joining another union.  First, the County Labor Relations Ordinance was changed a few years ago by the Board of Supervisors (think lots of campaign donations by SBPEA and SEBA management) to make it nearly impossible to decertify a union.  Second, you only have a 30-day window to make this happen.  I suspect that window is not far off (360 days prior to the expiration of your contract).  I would not even bother to try except as a last resort. The largest bargaining unit for the San Bernardino County Safety Employees’ Benefit Association (SEBA) overwhelmingly rejected a proposal negotiated by union leadership to cancel a series of wage increases over the next two years in an effort to assist in balancing a $90 million deficit.

By a roughly three to one margin, the Safety Unit representing Sheriff’s Deputies and District Attorney Investigators, rejected the modification proposal. The smaller Specialized Peace Officer Unit also rejected by approximately a two to one margin. Continue reading

iePolitics: County Employee Union Supports Don Kurth

We know from experience that the San Bernardino Public Employees Association does not have a clue as to what it is doing regarding political action.  Here are a few cases in point:

  • $60,000 to Supervisor Gary Ovitt, the same supervisor who is asking employees to give up their raises for the second year in a row AND face layoffs whether employees give up raises or not.
  • $5000 to Supervisor Paul Biane, the same supervisor that District Attorney Mike Ramos has named as John Doe No. 5 in a criminal corruption scandal.
  • $300 to Assemblyman Anthony Adams in the middle of a recall campaign.
  • $10,000 to District Attorney Mike Ramos amid numerous charges of hostile work environment.

Why?  Well for one, Bob Blough and Scott Ryan wanted front row seats at the State of the County address and they earned them with a $50,000 donation to Supervisor Ovitt.  As for the others, we can only guess. Continue reading

iePolitics: SEBA Strong-arming Its Members?

iePolitics is receiving reports that Safety Employees Benefit Association (SEBA) members are receiving calls from SEBA brass advising that SEBA is sending people by their homes to put on Rod Hoops signs in their yards.   Apparently, employees are NOT being given a choice and employees who resist will be reported to Sheriff Hoops.  Doesn’t this violate something?

ACU: SEBA a “Non-Adversarial Approach”

In the last couple years I have heard many terms used by SEBA’s staff and their attorneys.

Terms like, “I have to work with these people everyday”.  “Don’t care the Deputies lied”. “What do you care it’s not your money”.  “Not a good idea to upset Judges”. “Not a good idea to sue cops”. “Not a good idea to put management on the witness stand”. “We enjoy a good working relationship with management”. “No we can’t do that to another SEBA member because we will have to represent them later”. “It’s their department they can do whatever they want”.

And now someone says, we take a “non-adversarial approach” in dealing with the County. Continue reading

iePolitics has received information that Safety Employees Benefit Association (SEBA) president William “Beef” Abernathie has negotiated a deal with the county behind the backs of SEBA members to cut the pay raise to 6 percent and postpone it for two additional years.  We are awaiting clarification and will post it as soon as it is received.

I had the opportunity to spend some time yesterday discussing the current San Bernardino County’s budget situation and was able to obtain some feedback on the thinking behind what is happening, and to further explain my point that not reducing the county workforce now, will cause greater pain later.

Let’s face it. Signs of the current economic downturn were visible as early as 2006. I brought up the potential collapse in real estate prices and the effect on the county while working at the Assessor’s office then. I was laughed at by many at the government center.

InlandPolitics Commentary: Public employee unions should consider layoffs

The “800-pound budget gorilla” is in the room for both Riverside and San Bernardino Counties, which is putting their respective employee unions in a critical dilemma.

Push wage and benefit concessions on their members or trigger layoffs. Layoffs cause reductions in union member rolls thus affecting revenue that supports operations.

In mild economic downturns, wage deferrals or not filling vacant positions can be a viable band-aid to get through the problem.

Not this time.

The current collapse in property and sales tax revenue in both counties is devastating, and will continue for some time. San Bernardino County, which has not been as aggressive as Riverside County in reducing its property tax rolls, took a 6% hit last year and is likely to take another hit of at least 9% this year. At some point before you are released from your interview with IA, you will be ordered not to discuss the investigation with anyone but your lawyer, SEBA representative or your Commander. LOL!!! don’t say anything to your Commander he or she is not going to be your pal in all this.

The Department like any other Law Enforcement agency has a responsibility to the public to investigate mis-conduct and be free from interference from you or anyone else in order to complete that investigation.

It is my position that once that investigation is complete, and you have been given notice of the proposed discipline by the department, their investigation is DONE.  What seems to happen depending on the nature of the charges and who you are, IA will again admonish you to remain silent. I know my commentary about SEBA and Internal Affairs might not be as exciting as reading about Mark Uffer’s recent $15 million dollar claim against the County right now, but even the general employees might learn a few things from all this.

What SEBA and SBPEA have in common is they don’t take management to task when they get caught doing bad things to people.  If SBPEA had taken Mr.Uffer to task long ago, HE MIGHT have been fired long before he did, JUST maybe? Continue reading

iePolitics: Sheriff’s Hoops’ Campaign Forms

Well by now Rod I’m suspect you think you know the reason we’re using this blog to help your opponent.  Although you may think it has to do with January 1, it doesn’t.  It has to do with the fact that your deputies refused to take a burglary report and make an arrest when it was so clearly warranted—you know, unlawful entry into a dwelling to commit theft or any other felony.  I have talked to at least a half dozen attorneys (because, yes, you and the county are being sued) and they are flabbergasted that the Sheriff”s Department would not take a report under such circumstances, thus causing me to lose $20,000 or more in property.  Any other citizen would have received proper service, but I’m special.  You think you have the right to use your position to revenge your friends, such as Mark Uffer and Mike Ramos.  And I do have the right to use my blog to see that you are not elected to a new term.

Now that I’ve looked at your campaign forms, I guess I know why I was given the treatment I was.  I remember the discussion I had with the detective and lieutenant about the blog and one looked at the other and said, “I’m glad I’m not political.”  And the other replied, “I’m glad I’m not either.”  Lo and behold, guess who is on your list of campaign contributors?  Gee, if it isn’t the detective and lieutenant that were supposed to calm the waters.  So, once again you’ve given me “special” treatment, haven’t you? InlandPolitics: S.B. County budget plan currently rests on employees, unions

San Bernardino County announced last Friday that it was delaying a planned budget workshop for another month.

For a county that has been asleep at the switch in closing an estimated budget shortfall of $90 million-plus in its upcoming fiscal year is anyone surprised?

Neighboring Riverside, Orange, Los Angeles, and San Diego Counties have at least been continually taking budget reduction steps in an effort to keep their respective situations manageable. Continue reading
