(SAN BERNARDINO) While delivering an address to the Fontana Rotary Club on Monday, county of San Bernardino County Executive Officer Greg Devereaux took shots at two of the five members of the county’s board of supervisors over the budget process. According to a report published today in the Press Enterprise, Devereaux praised Chairwoman Josie Gonzales and Supervisors Janice Rutherford and Gary Ovitt. He omitted Supervisors Neil Derry and Brad Mitzelfelt.

The budget was approved on a 3-1 vote. Supervisor Mitzelfelt voted against the budget in part because it made significant cuts to public safety. Supervisor Derry refrained from voting due to legal issues at the time.

Supervisor Neil Derry

(SAN BERNARDINO) – San Bernardino County Third District Supervisor Neil Derry earned two impressive endorsements in recent days in his fight to keep his seat on the San Bernardino County Board of Supervisors. He is being challenged by San Manuel Band of Mission Indians Tribal Chairman and casino boss James Ramos.

Today, the Howard Jarvis Taxpayers Association announced its support for Derry. “The Howard Jarvis Taxpayers Association Political Action Committee endorses Neil Derry for reelection to the San Bernardino County Board of Supervisors,” declared HJTA Committee spokesman Kris Vosburgh.

“The Howard Jarvis Taxpayers Association is California’s largest and most influential taxpayer advocacy group. They have been fighting to protect the rights of taxpayers for over three decades,” stated Derry. “I am honored to be one of the very first elected officials in California to earn their coveted endorsement for the June 2012 election.”

Examiner.com: Rep congressman endorses casino boss, dem in county race

(SAN BERNARDINO) – Congressman Jerry Lewis (R-Redlands) endorsed San Manuel Tribal Chairman James Ramos this week in Ramos’ bid for a seat on the San Bernardino County Board of Supervisors.  Ramos has served as a member of the San Bernardino Community College Board of Trustees since 2005. He is also a member the California Board of Education since his appointment by Governor Jerry Brown in January of this year.

Lewis’ endorsement raised eyebrows among county Republicans.  Ramos is a Democrat who is running against a conservative Republican incumbent, Supervisor Neil Derry.  Many Tea Party members and Republicans alike have accused Lewis of being a RINO (Republican In Name Only) and an opportunist with this endorsement.  Ramos and the San Manuel tribe contribute heavily to political campaigns in the region, including that of Congressman Lewis.

Clearly, The Editor has decided to believe a convicted felon, Bill Postmus, who negotiated a deal with the District Attorney to obtain more favorable treatment in exchange for dismissal of numerous counts.  One of those counts was conspiracy to accept a bribe.  If he was willing to accept a bribe once, would he not accept dismissal of charges in exchange for false testimony?

Simply put, the primary witness of the Derry prosecution is highly impeachable on any witness stand.

Examiner.com: County supervisors challenge fire tax signed by governor

SAN BERNARDINO – Today, San Bernardino County Third District Supervisor Neil Derry urged the Board of Supervisors to authorize legal counsel to investigate and pursue legal remedies against the state in response to the recent passage and signing of Assembly Bill X1-29 by Governor Jerry Brown. The bill imposed a “fee” of $150 per inhabitable structure on all parcels within the “State Responsibility Area” under the guise of funding fire prevention programs.  Supervisors voted 4-0 to authorize the action.

Derry believes this bill is an illegal tax and comes in the wake of the state’s announcement that it would also no longer fund the air supertanker program used to fight wildfires through air drops.  He feels this maneuver is a stealth tax that explicitly circumvents the intent of the people of California when they resoundingly passed Proposition 26 in November 2010.

San Manuel Tribal Chairman James Ramos formally announced his bid for Third District Supervisor, the seat currently held by Supervisor Neil Derry.  One of the interesting things about this announcement is the list of supporters he has already garnered.  Those supporting his candidacy include city of San Bernardino mayor Pat Morris; city of Redlands mayor Pete Aguilar; city of San Bernardino city councilman Fred Shorett; city of Highland mayor pro tem Penny Lilburn; city of Yucaipa mayor Dick Riddell; city of Yucaipa councilwoman Denise Hoyt; President of San Bernardino Community College District Board of Trustees Carleton W. Lockwood Jr.; former Assemblyman Russ Bogh; and  Senator Bill Emmerson.

iePolitics: One more animal post for today and then back to politics

For the long-term, one thing that can help clean up Devore and the other county shelters is a mandatory spay and neuter ordinance.  Situations such as with Tilly, today’s featured dog, can be prevented.  There will always be irresponsible and lawless people, but most will abide by the law.  It will take time and education though.

Last year, Supervisor Neil Derry sponsored and got passed, with Supervisor Brad Mitzelfelt’s help, a mandatory spay and neuter ordinance for pit bulls.  It was a good start, but I am among many who do not favor breed-specific legislation.  The law should be no respecter of breed.

As we suggested might happen back in December, San Manuel Tribal Chairman James Ramos is announcing his bid to unseat San Bernardino County Third District Supervisor Neil Derry.  I was personally yelled at by Jim Erwin back then for even suggesting this might happen.  But as anyone who is not emotionally involved with the Third District race knows, the writing was on the wall.  Ramos has been gearing up for this for a long time.

Ramos has plenty of baggage.  He also has plenty of loot and could outspend all his competition 5-1 if he chose to do so. I suspect Derry will not be the only other candidate.  Remember, I have a really good crystal ball.

The Press-EnterpriseSan Bernardino County Supervisor Neil Derry should resign, to avoid further damage to public confidence in the county’s government. A county with a long, sordid history of government scandal does not need the embarrassing spectacle of yet another high-level official facing criminal charges.

The state attorney general’s office on Tuesday charged Derry with two felonies and a misdemeanor involving campaign funds. The complaint says that in 2007, Derry accepted a $5,000 campaign check from local developer Arnold Stubblefield. Derry then handed the money to a political action committee controlled by former county Assessor Bill Postmus. Postmus’ committee then gave an equal amount back to Derry, thus hiding the real source of the money. Postmus last month pleaded guilty to 14 felonies as part of an ongoing corruption investigation in San Bernardino County.

It has been interesting reading some of the comments on the various blogs on the newspaper sites regarding the charges filed yesterday by the AG against San Bernardino County Third District Supervisor Neil Derry.  It is obvious the significance of the charges has gone over the average reader’s head.

The Derry case has sent shock waves throughout the state. I had a chance today to speak briefly with a political attorney from one of the state’s most respected political law firms.  The AG is setting precedence with this case, precedence that will affect every politician running for office in this state.

Examiner.com: AG charges county supervisor with laundering campaign contributions

The California Attorney General’s office today filed three criminal charges against San Bernardino County Supervisor Neil Derry. The charges, perjury and offering a false document, both felonies, and failure to report a contribution, a misdemeanor, stem from a $5000 campaign donation by local developer to the Inland Empire Political Action Committee that the AG alleges was not properly reported and represents laundered contributions.

Derry, who was first elected to office as a county supervisor in 2008, ran on a platform of ethics reform.  Since taking office he has alone led the fight against San Bernardino County District Attorney Mike Ramos in what some call Ramos’ selective prosecution of his political enemies.  Derry assisted former District Attorney Investigative Technician Cheryl Ristow when she came forward about threats made to her by Ramos if she did not agree to lie about their long-term romantic involvement.  Ristow is one of five women who have claimed they have been romantically involved with the married district attorney.

iePolitics: Inaccuracies in the Attorney General’s affidavit – Revised

I will have a story up before the night is over.  You can find the affidavits on the PE’s website and my story will include some things that simply are not true.  It seems the DA and AG are kindred spirits.  I wonder how they will explain it in a court of law.

Update:  I’ve been asked not to write this story and I don’t know why.  Hopefully, I will have an answer tomorrow.  I will stand by my original comment that there are some things in the AG’s affidavit that are not true.

iePolitics: War of words

I have to admit I was surprised to see retired Judge Chris Warner’s response to former supervisor Dennis Hansberger’s accusations regarding the Colonies settlement.  I was also surprised Judge Warner recently retired.  My understanding is he is battling a serious illness, which may account for his retirement and his need to speak his peace.

I have said from the beginning that no matter what anyone else has done in reference to the Colonies settlement, I believe Judge Warner acted in good faith and in accordance with the law.  I was Judge Warner’s first secretary when he was appointed to the bench.  He was meticulous and conscientious about his decisions.  He was very highly regarded.

I argued at length with a newspaper reporter not long ago about Judge Warner and his background.  I cannot remember for sure if Judge Warner ever worked as a prosecutor, but he came from a solid private practice.  He did not need the money.  As a matter of fact, he likely took a pay cut when appointed to the bench.  He also did not answer to the district attorney like so many other judicial appointments do.

  1. Who is paying for the office space in the County Governement Center or anywhere else?
  2. Who is paying for the salary of the elected leader?
  3. Who is paying for the benefit package of the elected leader?
  4. Who is paying for the salary of the elected leader’s staff?
  5. Who is paying for the benefit package of the elected leader’s staff?
  6. Who is paying for the office furniture?
  7. Who is paying for the copy machine, fax machine, scanner, computers, and telephone?
  8. Who is paying for the paper, files, pens, pencils, erasers, file prongs, paper punches, clue, paperclips, etc.?
  9. Why are files created?

iePolitics: Is Dennis Hansberger back in the game?

Numerous sources are telling iePolitics that Dennis Hansberger is bored and wants his old job back.   Former BOS Chairman Ovitt appointed Hansberger to a board without consulting first with Supervisor Derry.

Hansberger is working with Supervisor Josie Gonzales to deliver payback to Supervisors Neil Derry and Brad Mitzelfelt.   The chatter is that both Supervisor Gary Ovitt and Supervisor Janice Rutherford have aligned themselves with Josie against Derry and Mitzelfelt.

The year was 2006.  If you voted in 2006, you probably voted to do just that.

A county charter is similar to a state constitution or the Constitution of the United States.    It can only be changed by a vote of the residents of that county.

San Bernardino is one of only 14 counties in California which is governed by a County Charter.  San Bernardino County Board of Supervisor salary is part of the County Charter.

It’s been over a year since we first started writing about the abuses at Arrowhead Regional Medical Center (ARMC), San Bernardino County’s only county-run hospital.  And it’s been over six months since doctors appeared at the Board of Supervisors meeting to express their own concerns.  During this same period of time, the Federal Bureau of Investigation raided ARMC and took boxes of records.

iePolitics: Depositions start to fly in the civil corruption cases

Do you swear or affirm that the testimony you are about to give is the truth?

Some defendants in the civil corruption cases have started receiving depo notices.  Bill Postmus, Jim Erwin, Greg Eyler, Rex Gutierrez, and Adam Aleman are all named in the lawsuit.

In response, the defense is sending similar notices to specific members of the Board of Supervisors, their current/former chiefs of staff and other current and past staffers who  are familiar with time card fraud and campaign work on county time.   Let the fireworks begin as the county’s hypocrisy is made public for all to see, that is if those depo’d tell the truth.  We shall see.

This week’s public battle between Supervisors Neil Derry and Josie Gonzales has a lot of people rolling their eyes.   Many don’t realize that even if Gonzales is indicted, she will remain chairman of the board as the County Charter has no provision to remove her.  We have to admit all of this is pretty funny.  But the  humor in the public tit for tat belies the serious consequences the behind-the-scenes conflict could have for county residents.

Although Gonzales is the cover girl for the current round of fighting, she is merely a puppet for two very devious puppeteers attempting to maintain a stronghold on the Fifth Floor in an effort to hide and cover up.  Derry’s “sunshine” would expose their evil, and often times, illegal deeds.

iePolitics: How we really feel

I have to say we have very mixed feelings about what happened at the San Bernardino County Board of Supervisors today.  On one hand, Supervisor Brad Mitzelfelt needed a wake up call.  But I seriously doubt he got the message.  He is too far removed from his constituents and from this valley to know what is going on or why there is so much animosity towards him.  In the end, however, he does not deserve to be chairman.

As far as Supervisor Josie Gonzales goes, I honestly don’t care.  She is useless and will simply be a tool of Devereaux and Ovitt.  Gary would not have controlled Brad but Greg would have, so no harm, no foul here.

Seriously, all four of them are rumored to be taking the top spot tomorrow.  Josie has promised to be a capital B if she doesn’t get it.  Neil has his own plans.  And Brad and Gary are so out of touch with everyone and everything they probably won’t know if they are elected chairman or not.  Perhaps we should just give it to the new kid on the block and make it easier on everyone.

iePolitics: Will our BOS follow Brown’s lead?

Governor Jerry Brown, a Democrat, is returning $7 million to the state’s treasury and cutting his office budget by 25 percent.  According to an article in the January 8, 2011, edition of the San Francisco Chronicle:

As expected, Brown axed the secretary of education position, an advisory office under the governor that was worth $1.9 million annually. Brown also returned the lion’s share of transition funds allocated to him, spending just $120,000 of the $770,000 available.

He also cut $4.5 million from the governor’s office’s $18 million annual budget, in part by eliminating the office of the first lady. Brown’s wife, Anne Gust Brown, has already taken an unpaid position as special counsel to the governor.

“California is facing a huge deficit and it is necessary to find savings throughout all of government,” Brown said in a written statement. “We all have to make cuts and I’m starting with my own office.”

In order to cut one-quarter from his office’s budget, Brown eliminated the position of cabinet secretary and all deputy cabinet secretaries. He cut press and communications staff; closed field offices in San Diego, Riverside and Fresno; and cut the governor’s Washington, D.C., office staff. Additionally, as Brown announced in December, he eliminated the office of Laura Chick, the special inspector general appointed by former Gov. Arnold Schwarzenegger to audit federal stimulus spending in California. That position was temporary and set to expire midyear.

So, if a Democrat can do it, how about our four Republican members of the San Bernardino County Board of Supervisors?  Do you all really need deputy chiefs of staff, district directors, or media relations staff?  Do you really need more than one field office?    We think not.

iePolitics: It’s time to get serious about the new chairman

We have had some fun opining over whether the next chairman of the San Bernardino County Board of Supervisors will be Neil Derry, Brad Mitzelfelt, or Josie Gonzales.  The decision will be made Tuesday and it is time to get serious.  Whoever is elected will direct county policy for the next two years.  And that is a very big job as we have seen with all the new policies put into effect these past two years.

Chairmans make some very rough decisions.  Think about it.  Chairman Gary Ovitt had to address the elevator schedule for rides to the Fifth Floor so that Fifth Floor execs wouldn’t be inconvenienced by the little people . . . we mean non-exempt employees . . . trying to get from one floor to another to get work done.  And then there are those pesky constituents who might show up on the Fifth Floor expecting to speak with their elected representative.  I know from experience lower echelon employees are forbidden from gracing those hallowed halls even with an invitation so there must be policy on how to keep them out.

Supervisor Derry: Supervisor Derry Praises Emergency Response Efforts in Highland

SAN BERNARDINO, CA – In what has been the most significant flooding in the City of Highland’s history and generated national news coverage, Supervisor Derry expressed his gratefulness and gratitude for the more than 1,500 first responders and relief personnel that worked throughout the holiday to assist the residents.

“The flooding turned many lives upside down and replaced a season of joy and happiness with fear and uncertainty. These workers are to be commended for answering the call of service and working tirelessly throughout the holiday to help victims of the flooding,” Supervisor Derry stated. “They gave the best Christmas gift that anyone could ever ask for and that is knowing that you have somebody there when you need them most.”

This area of Southern California is vulnerable to a wide array of natural disasters.  Be it earthquakes, fires or floods, the people of this community as well as our neighbors in the region have shown time and time again that they will stand up and be counted when they are needed.

Bill Tuck Jr. asked for the salaries for the Second District.  Here are  the salary and benefit packages for all of the board staff.  This list does not include John Richardson, Mary O’Toole, Mark Kirk, Bob Page, and the other analyst whose name I forget from the Fourth District whose positions were transferred to the County Administrative Office budget.   That equals at least another million dollars.

iePolitics: Potential Opponents

We have taken a bit of criticism for suggesting possible opponents for Supervisors Mitzelfelt, Derry and Gonzales.  Those who pride themselves in their astute political analysis have been quick to point out where we are wrong.  What few are considering is the effect redistricting will have on the 2012 elections.

Politicians are politicians, meaning their political careers are foremost in their minds.  Many could never earn what they earn if they had to work a real job.  Getting re-elected so they can maintain their power and lifestyle is all that is important.  Continue reading

iePolitics: Devereaux to BOS: A warning shot

Yesterday’s sentencing of Rex Gutierrez to 32 months in prison was a warning shot.  Judge Rouse said it was a warning to public officials.  But really it was a warning to the Board of Supervisors and their staffs—not a warning from Rouse but rather a warning from their new power-hungry County Administrative Officer Greg Devereaux.

Devereaux has had the evidence for months that Human Resources Director Andrew Lamberto lied under oath in the three hearings involving Rex Gutierrez.  This is not only a crime, but a violation of county ethics.  But Lamberto is protected by Devereaux, and for good reason.

Really?  It takes exactly ten minutes to place a phone call to Andrew Lamberto and tell him to have my benefits issued.  After all, he is the one who lied to Hartford Insurance and told them that the county offered me a job and I declined.  No such thing happened.

Last week, 81 days after Supervisor Brad Mitzelfelt personally said he would look into my situation, I met with him face to face.  He actually had the nerve to ask me, “Why should I help you?”  Gee, maybe because I’m a constituent?  An employee?  Your department head lied under color of authority—something any other county employee would be fired for?  Because you made an oath to uphold the laws of the state of California which say that the county must provide disability insurance to its employees?

This is one of those posts where I made myself wait 24 hours to write.  Just  received an email that Mitzelfelt is going to deal with my situation after the first of the year.  As of today it is 87 days since he first agreed to “help.”  I will let him decide if he wants to share my response with all of you.

The bottom line is I’m tired of being threatened and blackmailed with my job and my livelihood by Devereaux, Mitzelfelt, Derry, Kirk and others.  I sick of being told that they will withhold the money they owe me until I shut down the blog, resign, and/or only write positive articles about them.  I am also tired of being threatened over some other issues in my life.

I think that while Biane was on the board, he, Ovitt, and Gonzalez were the innefectual majority tied to the scum bags, like Doreen Boxer and Ruth Stringer. Brad probably knew better but had to go along to get along because he and Derry couldnt do anything by themselves. Now that Rutherford is here Brad has the cover he needs to be the supervisor he wants to be, an effective and honest supervisor? Would you agree with that?

Do I agree with this?  There is no short answer.

First of all, there is mounting evidence that a Brad-Neil-Janice alliance may not be in the works after all but rather Neil may be left out on his own.  We will know for sure in a few weeks.

But, for argument’s sake, let’s say Brad is going to do the right thing.  I have said it before.  I do not believe Brad is inherently corrupt like Josie and Gary.  Brad has done a very good job for the First District in terms of getting us our fair share of resources and representation.

The 2012 election in San Bernardino County could prove to be more than a little entertaining.  Supervisors Brad Mitzelfelt, Neil Derry, and Josie Gonzales will all be up for re-election.

First, there is a wrinkle we only see every ten years and that is redistricting.  It is quite conceivable that current supervisors will attempt to have their potential opponents sent packing to a new district.  That was done many years ago to Jerry Eaves, who was forced to move in order to run for the Fifth District seat.

iePolitics: A Response

This comment appeared on the blog today in response to the most recent post regarding San Bernardino County Public Defender Doreen Boxer:

In reading all of the different articles and comments, here some of you get it and some of you don’t. Being very close to all of the players nothing is cut and dry. Greg D. is not the finally say in anything. A few members on the 5th floor run the show, but there is a process.

That process is never on the time frame that Sharon, Jim, ACU, or the regulars write about here. You guys do a great job spelling out what should happen. Well, it’s already happening well before you even start writing about it. You do a great job getting everyone on the sidelines ready for the kick. However, many of these issues need a little more time before you start second guessing what is being done. None of you speed things up and often slow the process down. I do not fault any of you for this, it’s just the truth.

Sharon’s followers have stepped up and made the difference and we take nothing away from you on that. It sounds like I praise the most of you and then take it away. I am not. I am just sharing with you about the process and how long these things take. Many of you should be proud of the end results and of your actions. The love hate relationship that most of you have with the 5th floor “offices” is questionable.

You give accolades in one article and then beat up Neil, Brad, Greg D., otheres on the very next blog. It’s like my mother telling me she loves what I did with cleaning her garage, and then smacks me in the back of the head for putting her dust pan in the wrong place. Please everyone, lets all get our meds leveled out and stick with one side or the other. I have! Wish I could tell you more. But for now, try having a love feast with some of the ones you have mentioned here. You have mentioned three or four departures that you are very happy with.(you left a few out) Give Greg, Brad, Neil, Janice and others some time and you will see many more positive changes sooner than later. Oh and “God Bless”, trust in that.

I thought it deserved a response that is not hidden under the article.

First, let’s address the “love hate relationship” with the Fifth Floor.  I guess that can best be summed up as saying we are not politicians.  In other words, we have zero interest in being politically correct, in brown nosing, or in doing what we do to make friends.  If, for example, Supervisor Neil Derry does good, we are going to praise him.  If he does something less than ethical, we are going to criticize him.

Now, that’s not to say that we don’t let some slide a little more than others, because we are human and we do appreciate a job well done.  Neil is one of those, although at times I’m sure he doesn’t believe it.  Brad is another and I know he doesn’t believe it.  If  Brad only knew some of the articles I have not printed in order to keep some semblance of a working relationship with the First District since I live there.  But he does not believe that.

PE: Cook leaves options open for 2012

Assemblyman Paul Cook says “everything’s on the table” as far as his political career is concerned.

Cook terms out of the Assembly in two years. Earlier this week, the IEpolitics blog mentioned Cook, R-Yucca Valley, as a potential 2012 candidate for the San Bernardino County Board of Supervisors. Cook lives in the Third Supervisorial District, currently represented by Supervisor Neil Derry, and much of his Assembly district’s San Bernardino County portion overlaps the Third (see below.)

Next year, though, supervisorial districts will be redrawn to reflect population changes since the 2000 census. Yucca Valley could stay in the third or potentially end up in the adjoining first district of Supervisor Brad Mitzelfelt.
