Needles Desert Star: Hospital CEO Mark Uffer stepping down

NEEDLES – A little more than a year after joining the local hospital Mark Uffer, chief executive officer for Colorado River Medical Center, will be stepping back into a consultant type role. Uffer said that will likely happen after the hospital board meeting scheduled for Dec. 1. He recommended the board approve having Dr. Frank Comunale step in as the interim CEO.

Comunale was introduced at the Nov. 3 meeting to develop a collaboration with San Bernardino County Department of Public Health, Behavioral Health and Arrowhead Regional Medical Center. He was also contracted to seek grants for rural health services and provide a level of physician oversight at the hospital.

Uffer said he notified hospital board president Jeff Williams and board member Terri Anderson Nov. 7. He then notified hospital employees the week of Nov. 14 of his plans. While his contract allowed either him or the board to give a 24-hour notice of termination of employment, he said he’s given the board about a month’s notice.

Examiner.com: County supervisors fight whistleblower lawsuit to the tune of nearly $800,000

(SAN BERNARDINO) In November 2009, when members of the San Bernardino County Board of Supervisors voted 3-2 to terminate County Administrative Officer Mark Uffer without cause, which provided him with an additional year of salary and benefits, they thought they were avoiding a legal hassle.  Instead, they opened a costly can of worms that has now cost taxpayers an additional $782,452.20 on top of the $323,000 severance package.

As early as 2008, at least one member of the Board of Supervisors indicated he wanted to terminate Uffer’s contract and replace him with then-Ontario City Manager Greg Devereaux.  Fourth District Supervisor Gary Ovitt was a close friend to Devereaux and worked with him when he was mayor and as a member of the Ontario City Council.  However, the three votes to replace Uffer with Devereaux did not materialize until October 2009.

In 2008, the first of numerous arrests of high-ranking county officials was made.  By 2009, the corruption scandal had clearly touched the Board of Supervisors with the arrest of Third District Chief of Staff Jim Erwin.  Several other board staffers were subpoenaed to testify before the Grand Jury and were also interrogated by the District Attorney’s Public Integrity Unit.  The investigation has been far reaching with three members of the Board having now been charged criminally and at least two others possibly facing charges in the future.  Two chiefs of staff have also been charged and one is working as an informant with the District Attorney’s office.

iePolitics: Supervisors Interfered With Employment Attempts

Editor’s Note:  This post was sent to iePolitics.  I found it very interesting because I, too, have been a victim of Brad Mitzelfelt trying to convince prospective employers not to hire me.  As a matter of fact, two different people, both of whom Brad thought I was working for, were approached by Brad and/or Megan Mitzelfelt in an attempt to have me fired.  Yes, that is right.  Megan also tried to use her influence as the PIO at County Fire to have me fired from a job I did not even have.  What she doesn’t seem to understand is just how many people at County Fire/Special Districts hate her and the way she throws her weight around as Brad’s wife to try to get special privileges.  So this stuff always gets back to me.  Hey Megan, 420 time?

Credible information has come to light that implicates certain members of the Board of Supervisors and their attempts to interfere with former CAO Mark Uffer’s employment attempts.  It seems that firing him wasn’t enough for the supervisors that were involved; they wanted to make sure he was not employable as well.  Cooperating with the authorities aside, it seems that they really wanted to damage him.  The supervisors fired him for no cause instead of allowing him to resign then disparage him subsequently in public forums.

The county filed a motion for summary judgment several weeks ago requesting that the last of the last cause of action, whistleblowing, be dismissed.  The judge took the matter under submission.  Trial is currently scheduled to start for October 11, 2011.  Since depositions are still be taken, it does not seem likely the trial will start on October 11.

iePolitics: Trying to remember

The first Fair Political Practices Commission (FPPC) complaint I ever filed was against First District Supervisor Brad Mitzelfelt and Reggie King from Young Homes.  I can’t remember the details except that King was trying to hide his campaign contribution through a defunct corporation or something like that.  I believe I filed under the money laudering section of the code.  Brad was required to amend his FPPC 460 and King received a warning letter.

It took all of 48 hours to get responses from the Superintendent of Schools, SANBAG, and SCAG.  I don’t have everything yet, but at least someone acknowledged my emails, which hadn’t been done for anywhere from two to six weeks.  And government employees wonder why they are the number one target right now.

This blog has never been about the 95 percent of the government workers who go to work and try their best to do their jobs each day.  It’s about those “five percenters.”  Yes, I used that term but not in the same way Mark Uffer used it to bully and humiliate us.  Despite his presentation, we all know that five percenters exist and they make every government worker and politico look bad.

Back in October I received a letter from the county’s attorney that I would not be given representation by the county during the Mark Uffer deposition like all other county employees were being given.  The county claimed the deposition had nothing to do with my county employment.

First off, it’s a little late in the day, but HAPPY NEW YEAR to everyone.  Let’s start  with the easy predictions first.

Arrowhead Regional Medical Center

If the Federal Bureau of Investigation has control of the investigation and is conducting it thoroughly, we have every reason to believe that Mark Uffer, Josie Gonzales, Paul Biane, Dr. Dev GnanaDev, and Jessica Brown will be indicted.  There could be numerous other elected and appointed officials involved as well but those are the names we hear were on the search warrants.

This prediction is based on my own observations while I worked at ARMC as well as talking with those that were required to provide officials with service.  My former desk partner had worked in the emergency room and was responsible for processing in many “VIPs.”

VVDP: Leaving the cheese unguarded

We published the other day a list of local public employees who have secured buyouts from their organizations on their way out the door, prompted by the latest, Oro grande School District Superintendent Kim Moore’s pocketing $326,000 as part of his being released from a four-year contract with the district. He was in the first year of that contract.

On the list was Marilou Ryder, given $350,000 when she resigned as Victor Valley Union High School District superintendent; William Pattison, who got $100,000 when he left the Town of Apple Valley as finance director; Mark Uffer, given about $274,000 after being fired as San Bernardino County Administrative Officer; Julian Weaver, fired in 2008 as VVUHSD superintendent, who got $230,000 as a parting sop; and Greg Lundeen, given $124,500-plus when he retired early from VVUHSD as superintendent.

The list didn’t include Hesperia Unified School District’s Hank Richardson, who left that district as superintendent in 2007, but kept his salary of $163,000 a year, plus $10,000 a year, until 2009. That worked out to about $350,000.

iePolitics: How the Public Defender situation was allowed to happen

I’m told that County Administrative Officer Greg Devereaux witnessed something this past week that caught even him off guard.  As we reported earlier, Public Defender employees were called into a 5 p.m. meeting on December 14 where Devereaux announced the termination of Public Defender Doreen Boxer and the demise of her lieutenants, Lauri Ferguson and Martin Dante.  He also announced the appointment of Phyllis Morris  as interim Public Defender.  Employees stood and jubilantly clapped and cheered at the news.

Obviously, Boxer, Ferguson and Dante, were despotic managers who ran amok.  To effect such emotion out of most of a department’s staff, however, takes more than bad managers.  In a system where there are checks and balances, four years of illegal personnel actions and a hostile work environment simply should have never happened.  But it did.

iePolitics: Substance abuse in the First District

Every since the revelation that former First District Supervisor Bill Postmus has a drug addiction issue the question has been raised about how his chief of staff and now First District Supervisor Brad Mitzelfelt could not have known.  Of course, the answer is that he did know.  You can’t be around an addict that long and not know.  So why didn’t Mitzelfelt do something about it?

The answer to that is a two-parter.  First of all, he was scared.  As I have learned while dealing with him, Mitzelfelt has no backbone, partially because he has so many of his own skeletons, among them his own substance abuse issue and that of his wife’s, Megan.

Mitzelfelt is a very heavy drinker, so much so, that some of those very close to him are worried he cannot stop and could harm someone while drunk.  I can speak from personal experience with Brad that he is still in the denial stage and has no interest in help or in stopping.  Mitzelfelt is an introvert and alcohol gives him the ability to deal with his very public life.

NEEDLES — With few items on the agenda, Colorado River Medical Center chief executive officer Mark Uffer was able to give a full update on the progress of the hospital during the board of trustees meeting Nov. 18.

Part of the focus was on the financial status of the hospital. He also pointed out the three different cost reports and amounts owed to Medicare by the hospital.

The first of the three is for a total of $260,217.26 to be paid off in 60 months. The monthly payment is $6,015 with an interest rate of 13.71 percent.

Reading the spin from county personnel on the issues at San Bernardino County-run Arrowhead Regional Medical Center (ARMC) has been interesting.  Or perhaps disgusting is a better word.

Some of you may remember the Fair Political Practices Commission complaint I filed back in March against Mark Uffer and Supervisors Paul Biane and Josie Gonzales.  I received notice from the FPPC that there was no violation despite the fact that all three of them along with countless others had been given free medical care at ARMC and did not report this gift of public funds on their FPPC Form 700s.

iePolitics: My personal experience with free medical care at ARMC

I won’t bore everyone with the details that led up to it, but the bottom line is that in 2008 the county of San Bernardino cut off my medical insurance illegally.  I had used Kaiser for close to three decades and suddenly had nothing despite a number of physical issues as well as the fact that I was dealing with major depression from a workplace injury.

The bottom line is that I had no way to get any of my medication including anti-depressants.  The end result was my first suicide attempt.

I was supposed to be returning to work but was pretty distraught and very depressed.  At that time I was still friends with Mark Kirk, who was Supervisor Ovitt’s chief of staff.  Kirk went to bat for me with then County Administrative Officer Mark Uffer and asked him that the county reinstate my medical insurance so that I could get my medication.  Uffer instead insisted that I go to the Emergency Room at Arrowhead Regional Medical Center (ARMC).

iePolitics: The Brown pile

Perhaps this should be called “All in the Family – Part Three,” but as more and more comes out about Matt and Jessica Brown and Jessica’s mother Sandy Harmsen, somehow this title seemed more appropriate.  Matt, of course, is the former chief of staff for Second District Supervisor Paul Biane.  Jessica is an analyst in the County Administrative Office.   Harmsen is the director of the Workforce Development Department.

Sandy’s brother-in-laws, Adam, also works for the county as a social worker.  I’m not sure if any other family members are in county employ or not.

Recent weeks have seen all three of the family members in the spotlight.  First up was Sandy Harmsen, who as director of a department that is responsible fori spending large sums of federal stimulus money, was discovered to be falsifying records once again.  That is only a small part of what she is doing, but so far County Administrative Officer, Greg Devereaux, who Harmsen answers to, is covering for her.

What a surprise to us all.

Well, not really.

Saturday mornings local news articles related to federal agents raiding the facility and seizing records were horrendous to say the least.

All of those denials. Or should I say lies.

The most outrageous is courtesy of former ARMC administrator and fired county administrative officer Mark H. Uffer, who through his attorney Sanford Kassel, denies any knowledge of free health care for county elected and appointed officials.

Kassel says Uffer was shocked to hear about the goings on at ARMC.

San Bernardino County Second District Supervisor Paul Biane fancies himself to be a crime fighter.  Just ask him.  Or better yet, check out his campaign mailers where he takes credit for exposing the current corruption scandal.  He seems to forget he is named as John Doe No. 5 in the scandal he is claiming responsibility for uncovering.  In other words, he exposed his own wrongdoing.  And in his mind that means he should be re-elected to office.

Biane’s memory of past events seems to be failing.  For example, we find out today he forgot to tell his constituents about  his other criminal activity, that is, until he was reminded of it by an article in The Sun.  Not telling us until now about  his arrest five years ago for driving under the influence while in Illinois could be just an oversight we suppose.  But exactly how does one forget for four years that his driver’s license was suspended?  It seems he should have been reminded of that each time he turned the key in the ignition of his county-owned vehicle.

Biane’s memory got faulty again when he returned home from Illinois.  He forgot to mention his arrest when he returned to his job. Employees who drive county-owned vehicles are required to report any vehicle-related arrests to their supervisor, or in this case, Chairman Bill Postmus, or at very least, then-County Administrative Officer Mark Uffer.  Biane forgot . . . again.

Sources say County Counsel Ruth Stringer, who is expected to announce her retirement this week, is actively trying to delay her forced departure.

However, the question inquiring minds want to know is who is Stringer trying to stay around and screw over?

Stringer, one of the culprits responsible for feeding the investigation into San Bernardino County government and her bosses the Board of Supervisors, is said to be lobbying a certain county supervisor to allow her to hang around and cost county taxpayers more money from her incompetent decision-making.

I don’t think there are too many people who did not question the way in which former County Administrative Officer Mark Uffer was fired and current County Administrative Officer Greg Devereaux was hired.  Although long-time readers of iePolitics expected both events as we broke the Devereaux story months before Uffer was fired, non-readers were caught off guard.

Devereaux was picked out to succeed Uffer over a year before Uffer’s termination.  Mark and I had that conversation more than once.  I believe there may even be an email from me in his claim against the county hinting at that.

iePolitics: D-Day for Mark Kirk

Today is the big day for the Mark Uffer/Mark Kirk showdown of sorts.  Uffer has made numerous accusations against the former chief of staff to Chairman Gary Ovitt.  And now using some twisted mindset Uffer wants the one he accused to validate his claims that he was fired for being a whistleblower.

Kirk is scheduled for deposition today.  Uffer’s attorney has suggested the depositions will be videotaped and released to the media.  Can you say intimidation?  It seems that Uffer found the perfect attorney to match his own personality.

My morning started out just great!  I received an email from my attorney that former County Administrative Officer Mark Uffer wants to depo me in his lawsuit against the county.  I have to say that made my day. It’s been a long time since I laughed that hard.

Now, the real kicker in all of this is that the county has hired the exact same attorney to fight Uffer’s lawsuit as they have hired to fight one of my suits against the county.  Yet, the county has to provide me with legal representation in the Uffer suit.  This attorney actually had the gall to tell my attorney that he didn’t see a conflict if on one hand he is trying to pound me into the ground and on the other hand he is trying to get my cooperation in protecting the county from Uffer.

Yes it’s true.

Sources tell InlandPolitics.com that former San Bernardino County administrative officer Mark H. Uffer is now the incoming CEO of Colorado River Medical Center in Needles.

Terms of Uffer’s new position are cloudy, but sources say Uffer is seeking some type of “Per Diem” compensation until November 1, 2010 when his severance package with San Bernardino County ends.

Imagine this scenario:  I’m sitting at Starbucks having tea with one of the persons named in Mark Uffer’s lawsuit against the county.  My phone rings and an unfamiliar number is displayed.  Something makes me answer the phone.  I am asked if I believe Mark Uffer would make a good administrator for Needles Hospital.  My companion starts laughing hysterically.

It seems that Uffer has applied for the position.  There is a county employee in Needles who is pushing very hard to hire Mark and he is the only candidate to apply so far.  A background check is being completed.  In the process, someone finds a copy of the lawsuit Uffer has filed against the county and prints it out.  They read the very last page, which was an email from me and my parting shot to him where I called him a liar.

To the Honorable Members of the San Bernardino County Board of Supervisors,

Haven’t you had enough yet?  Honestly, why wasn’t County Counsel Ruth Stringer fired today?  She does not work for County Administrative Officer Greg Devereaux.  She works for you.  And she should have been fired TODAY!

I only wish I could share with the readers of iePolitics the details of her latest fiasco—a fiasco that has already been expensive and one that almost cost you, the taxpayers, an additional very large sum of money.

Late last week it was announced that Assistant Fire Chief Dan Wurl was named to replace retiring Fire Chief Pat Dennen.  And with that announcement came the stories and with the stories came the re-hash of last year’s trailer incident.  So the newspaper blogs were busy with derogatory remarks about both Dan and Pat.  And that’s a problem.

You see, the story that Mark Uffer and Andrew Lamberto told to the Board of Supervisors and the media wasn’t exactly the truth.  As a matter of fact it was a huge cover up for their own lies and empire building.  Those two tried to destroy Pat and Dan for their own financial rewards.  And Mark and Andrew covered for a few others who were greasing hands of certain politicians. Sometimes I really wonder who is the worst lawyer, District Attorney Mike Ramos or County Counsel Ruth Stringer.  From Ramos we have learned that the Constitution of the United States is not applicable in San Bernardino County, at least not in connection with political enemies.   And County Counsel Ruth Stringer has taught us that copulation involving public resources is covered by the “deliberative process” and therefore not subject to review, not that we wanted to review the copulation, only the expenditures attached thereto.

Now we find our two legal beagles are at it again.  Well, not with each other we hope, but in consort of sorts, with those at Arrowhead Regional Medical Center (ARMC) who wish to cover for the misdeeds of members of the Board of Supervisors, the county’s Medical Director Dr. Dev GnanaDev,  ARMC Chief Executive Officer Patrick Petre, and a handful of doctors and other ARMC employees. iePolitics: ARMC Billing–Taxpayer and Patient Nightmare

For anyone who has utilized the services of San Bernardino County’s hospital and is not an Arrowhead Regional Medical Center (ARMC) VIP, it comes as no surprise that ARMC’s billing system is a mess.  Those who handle the billing are spread throughout the medical center and no one talks to one another.  As a matter of fact, turf wars exist that sometimes result in billing being months, and yes, even years behind.  It is yet one more area of ARMC that its medical director, Dr. Dev Gnanadev, has micromanaged into disarray.

ARMC has traditionally served the indigent and low-income members of our county. As such, many receive Medi-Cal, SSI and other government entitlement programs.  Such programs are strict about billing, but if done correctly and timely, result in millions of dollars being returned to San Bernardino County.  “Correctly” and “timely” are the key words here.   Continue reading

iePolitics: To Add to Jim’s Comments

I feel sometimes like we are beating a dead horse.  Unfortunately, that dead horse keeps coming back to life and rearing its ugly head.  There are several San Bernardino County department heads that have to go.  The county simply cannot afford to keep them on in these economic times.  Federal court and federal juries do not care how broke San Bernardino County may be when it awards judgments.  And Mr. Devereaux, you have some complete idiots (note HROs:  be sure to print this out to add it to “the list”) running the show who are going to ultimately cost taxpayers dearly.

At the top of the list is County Counsel Ruth Stringer.  How much longer are you going to tolerate her half-ass legal advice?  When you take an attitude of “we have 138 attorneys, so bring it on,” as did our former County Administrative Officer and our current County Counsel has, you’re assuming you can outlast us all.  Not all of us go away easily or cheaply. iePolitics: I should clarify something for all the new readers

“My Life on the Public Dole” is the result of the County of San Bernardino claiming that this blog “creates a hostile work environment for county administrators” because we expose how corrupt they are.  Mark Uffer, our former County Administrative Officer, got pissed off at me back in October and had me taken off work and placed me on an unpaid leave of absence.  I haven’t had a county paycheck since November as my punishment.  So after having my utilities turned off, I decided to apply for Food Stamps.  Although I take that decision seriously, it is also being done tongue-in-cheek. Seems that the county can no longer afford subsidizing families while taking away health insurance from employees.  We hear that the county has proposed returning to flexible benefits dollars in lieu of the medical premium subsidy, which was Mark Uffer’s and Bob “Chicken Man” Blough’s brilliant plan to conquer and divide the membership so they would have more control.  Continue reading

InlandPolitics Commentary: Are S.B. County Supervisors victims of “snow job”?

One thing is certain. San Bernardino County’s budget problem is far more severe than anyone ever imagined. Especially the employee unions.

Looking at their websites and the information being provided to their members it appears everyone is about to be blind-sided by more bad news.

The county is clearly going to want the unions to cancel all negotiated wage and benefit increases. Yes, I said “cancel” not “defer”. A cancellation would have delayed any significant layoffs. Not anymore. Expect both. Continue reading
