iePolitics: So when are SBPEA members going to show some cajones too?

Does anyone really believe that SBPEA General Manager Bob Blough isn’t doing to SBPEA members behind the scenes exactly what Beef and now Laren were doing to SEBA members?  Yet SBPEA members do nothing but bend over and take it time and again.  I have long since given up on general county employees having an ounce of backbone.  I really believe they are getting exactly what they deserve.

I noticed a large number of hits coming from a site called www.indianrunner.net.  The site’s tag line is “A publication of opinion for Tribal Members by Tribal Members created by Members of the Morongo Band of Mission Indians.”  It would appear this publication confirms that Bill Abernathie was in fact hired to head up security and not everyone is happy about it.

Guess who Morongo Casino just hired as their new Director of Security? William “Beef” Abernathie!!! This is really exciting, I know about 140 officers who will be so glad to have such a wonderful role model as their “boss, the beef,” to run the department. Does anybody know how this person is qualified to run a department the size of a small county?

iePolitics: Can someone confirm, deny or clarify?

I have been told that our favorite former union boss, you know the advocate and protector of line staff, William Beef Abernathie, was transferred to Human Resources—you know, a nice 8-to-5 job with a take-home vehicle and weekends off.  I am sure it is just a coincidence and not a reward for a job well done but I digress.

Rumor has it that a certain captain’s son wanted out of the jail and a transfer to the Highland station.  The problem was that there were lots of more experienced deputies ahead of him.  But he got the transfer anyway.  Abernathie’s excuse?  He misread the hire date.  Like I said—a job well done.

iePolitics: Conspiracy Theory No. 3

As much as I have no use for the guy, I do believe CAO Greg Devereaux is brilliant, at least in comparison to those BOS members and employees he is manipulating.  One thing even his friends will say about him is that he likes to be conceived as an asshole.  He does not mind the heat from making employees’ lives miserable.

And as much as I dislike Bob Blough, he is a used car salesman extraordinaire that always comes out on the winning side in terms of what is best for himself.  He also doesn’t mind the heat from making employees’ lives miserable.

Now, think of the chain of events.  Last year Devereaux and Blough imposed a series of takeaways on General employees.  It was done with SBPEA’s help even though it violated collective bargaining laws.  They both knew employees would never mount a serious effort to fight it.

iePolitics: SEBA president to be indicted? – Updated

iePolitics has told that a meet of the SEBA Board of Directors took place last night to replace current San Bernardino County Safety Employee Benefit Association (SEBA) president William “Beef” Abernathie.  The board was advised that Abernathie is among the 27 expected to have been indicted in the POST scandal.  Those indictments are expected to be unsealed next week.  Abernathie is also a sergeant with the San Bernardino County Sheriff’s Department.

iePolitics: How do we get rid of SEBA?

Various versions of this question are popping up on inland empire blogs.  If this question was being posed by SBPEA members I would not waste the keystrokes because there is not even one pair of testicles among the 17,000 members.  However, you guys have shown some backbone and I’m proud of you.  So, let me give you a little insight.  But I’m prefacing this with it is 10:30 at night, I am only vaguely familiar with your Memorandum of Understanding, and it has been a very long time since I read either the San Bernardino County Labor Relations Ordinance or Government Code Section 3500 et seq.  I cannot remember off of the top of my head if SEBA is covered under the Meyers-Milias-Brown Act or not, but I have little doubt if I’m wrong here, Erwin will let me know in the morning.

This is the way I see it.  SEBA is not the problem.  SEBA leadership IS the problem.  While Jim was president, he built a powerhouse union because he was more interested in building a powerhouse union than in becoming a lieutenant.  SEBA’s focus has changed and as I already said, that is a leadership problem, not a union problem.  There are a number of ways to address the problem.

The most drastic is, of course, decertifying SEBA, and forming a new union or joining another union.  First, the County Labor Relations Ordinance was changed a few years ago by the Board of Supervisors (think lots of campaign donations by SBPEA and SEBA management) to make it nearly impossible to decertify a union.  Second, you only have a 30-day window to make this happen.  I suspect that window is not far off (360 days prior to the expiration of your contract).  I would not even bother to try except as a last resort. This commentary will be for those members of SEBA who need to know the Legal Defense Fund of Peace Officers Research Association of California are still dragging their feet on helping members out. At least around here.

Seems they cannot handle a members problem with any speed or efficiency without the member raising hell to get his or her problem handled.

Seems a former member of the San Bernardino County Sheriff’s Department discovered on his own, that an attorney assigned to him recently, quit or was fired from his law firm. In fact the lawyer had left at least 2 months earlier and only when the member inquired upon his own, did he discover the problem. Continue reading

The largest bargaining unit for the San Bernardino County Safety Employees’ Benefit Association (SEBA) overwhelmingly rejected a proposal negotiated by union leadership to cancel a series of wage increases over the next two years in an effort to assist in balancing a $90 million deficit.

By a roughly three to one margin, the Safety Unit representing Sheriff’s Deputies and District Attorney Investigators, rejected the modification proposal. The smaller Specialized Peace Officer Unit also rejected by approximately a two to one margin. Continue reading

iePolitics: Be Careful When Calling Us Liars

I can already see it now.  “You’re ruining that poor girl’s life.”  Yada, yada, yada.  Our three amigos, Grunt, Taylor and Phulakes, are very good at criticizing us, telling us we don’t have proof, and we shouldn’t be talking trash about the San Bernardino County Sheriff’s Department because these guys and gals put there lives on the line for us every day.  And I’ve written many times that we appreciate 98 percent of the employees who work for the SBSD.  It’s that other 2 percent that are the problem and most of them are supervisors or above.

But then we have days like yesterday and today where iePolitics has received very good information about crimes being committed by SBSD employees and being covered up by SBSD brass.  POST II was yesterday’s scandal.

Today we are going to discuss an old cover up.  It wasn’t particularly relevant and I honestly didn’t care.  It was ACU’s bailiwick, not mine, and I was just as happy to sit back and let the boys fight it out.  Then the “victim/perpetrator” had to chime in.  And that started a firestorm of private emails. iePolitics: SEBA Attorney William Hadden

The information in this commentary is for the benefit of those presently employed members of the San Bernardino County Sheriff’s Department.  READ carefully and THINK!!

I hope not only the general members of SEBA read this and take heed, but the station representatives who are concerned with William Abernathie and Michael Eagleson not being forthright in the fiduciary duties towards  SEBA members.

Members need to know that these same issues are going on with current members and their cases as we speak. If these issues are not brought forth, members will continue to suffer for the benefit of a few. Just like we are seeing every where else.

On February 5, 2010 I filed a 14 page complaint against SEBA attorney William J.Hadden of Silver,Hadden & Silver.

The complaint was filed with Peace Officers Research Association of California/Legal Defense Fund. The complaint was addressed to the Board of Trustees.

The Board of Trustees heard the case in San Diego, Ca on April 24, 2010. On May 18,2010 I received a letter from Edward Fishman the Legal Administrator for LDF.  I was informed by Mr.Fishman, that the Board has taken the appropriate administrative action against Mr. Hadden as a result of my complaint. Seriously, now you guys (and gals) know what it is like to have an ineffectual union in bed with management.  About time you share our pain!

I’m hearing a lot of muffled voices suggesting it is time you look for a new president.  Well, duh!  I wasn’t going to throw this out there until after the June 8 primary, but one name has popped up a time or two and that is Mark Averbeck.  He certainly has shown he is not afraid of Sheriff’s brass.  I seriously doubt you would ever find him with a brown nose.  Think about it!

iePolitics: Are Abernathie and Eagleson Lying?

I have received a couple phone calls in the last couple days, asking several questions about SEBA station representatives and specifically William Abernathie and Mike Eagleson.

The first issue was a question about how one goes about recalling a station representative. I am told by a person in the know, you seek out those at your station who are not happy with what your station representative is doing. If you have a majority, put it on paper, approach SEBA and the Executive Board and present your case. I think you will need the names of those who wish their station rep to be replaced. Basically you need a vote of no confidence at the station level.

Since I am hearing more than a few complaining about transperancy, those who wish to recall their station reps might wish to approach ALL the reps at a monthly SEBA meeting. I think that might be the better approach at this time. LET everyone know what is happening versus just a couple. Continue reading

ACU: SEBA a “Non-Adversarial Approach”

In the last couple years I have heard many terms used by SEBA’s staff and their attorneys.

Terms like, “I have to work with these people everyday”.  “Don’t care the Deputies lied”. “What do you care it’s not your money”.  “Not a good idea to upset Judges”. “Not a good idea to sue cops”. “Not a good idea to put management on the witness stand”. “We enjoy a good working relationship with management”. “No we can’t do that to another SEBA member because we will have to represent them later”. “It’s their department they can do whatever they want”.

And now someone says, we take a “non-adversarial approach” in dealing with the County. Continue reading

iePolitics has received information that Safety Employees Benefit Association (SEBA) president William “Beef” Abernathie has negotiated a deal with the county behind the backs of SEBA members to cut the pay raise to 6 percent and postpone it for two additional years.  We are awaiting clarification and will post it as soon as it is received.

iePolitics: Why Vote for Paul Schrader

Many might be wondering why they should vote for Paul Schrader.  Well lets look at some of what I believe to be common sense issues. NO masters degree needed.

This is nothing personal against Mark Averbeck. I admire his fortitude and no-nonsense approach to the Captain Gray scandal in the last week.  Some think that Averbeck’s approach is nothing more than political grandstanding.  Maybe.   Or maybe Mark is just tired of what he has seen in his career. InlandPolitics Commentary: Public employee unions should consider layoffs – Part Two

I had the opportunity to spend some time yesterday discussing the current San Bernardino County’s budget situation and was able to obtain some feedback on the thinking behind what is happening, and to further explain my point that not reducing the county workforce now, will cause greater pain later.

Let’s face it. Signs of the current economic downturn were visible as early as 2006. I brought up the potential collapse in real estate prices and the effect on the county while working at the Assessor’s office then. I was laughed at by many at the government center.

iePolitics: Sheriff’s Internal Affairs Part 4

At some point before you are released from your interview with IA, you will be ordered not to discuss the investigation with anyone but your lawyer, SEBA representative or your Commander. LOL!!! don’t say anything to your Commander he or she is not going to be your pal in all this.

The Department like any other Law Enforcement agency has a responsibility to the public to investigate mis-conduct and be free from interference from you or anyone else in order to complete that investigation.

It is my position that once that investigation is complete, and you have been given notice of the proposed discipline by the department, their investigation is DONE.  What seems to happen depending on the nature of the charges and who you are, IA will again admonish you to remain silent. It has come down from a couple sources that Sheriff’s Management has let it be known, that Sheriff’s personnel arrested for DUI would be on their own. What exactly does this mean?

If the Sheriff’s Department never covered these incidents up in the first place, there would have been no need to make such a statement to the Station Commanders.

Is Sheriff’s management now indicating in their own way alcohol abuse might be a problem within the Department as Sheriff Lee Baca did with his department a few months ago? Is the Sheriff’s Department taking to much heat in their long standing practice of covering up for DUI drivers? Continue reading

iepolitics: About SEBA Part 2

You might have heard the term, “obey now grieve later”.  This is managements and SEBA’s way of telling you obey all orders, then complain later about a potential problem with the order.

Just one REAL big problem with all that.  Who do you grieve too?  The one you are going to grieve to is the one who is generally creating the problem. For those of you that are happy with their level of service and representation over the years and those running the organization at this time, I respect that position if that is in fact how you feel.

For those who have offered Sharon help time and time again on a given number of issues, I thank you sincerely.

I have offered $100 bucks towards the total cost of getting her internet access 24/7 up and running so our comments come onto the blog immediatley, instead of around 10:00am everyday or whenever Sharon has access to her site.

Sheriff’s Internal Affairs Part 2

 

In part 2 we will discuss personnel files and issues related to that subject.  Remember what I said, “THINK” about these issues.

This is from the Goverment Code that pertains to the “Peace Officer’s Bill of Rights”. Pretty simple language actually, and the code must be interpreted by the Courts for it’s “plain language meaning”, and “legislative intent”.

As many of us have read over the years the words used by public officials, “I can’t comment on that, it’s a personnel issue”, or “confidential employee matter”.

This law as we know it, is becoming one of the most abused in the public sector.  Our public officials are claiming these laws apply in internal matters, and as we are starting to see, being used to cover up corruption.

San Bernardino County announced last Friday that it was delaying a planned budget workshop for another month.

For a county that has been asleep at the switch in closing an estimated budget shortfall of $90 million-plus in its upcoming fiscal year is anyone surprised?

Neighboring Riverside, Orange, Los Angeles, and San Diego Counties have at least been continually taking budget reduction steps in an effort to keep their respective situations manageable. Continue reading

iePolitics: SBPEA General Manager Playing Both Sides

San Bernardino County Budget Whiz Extraordinaire Dean Arabatzis is claiming that if county employees once again agree to forgo their raises this year (that is last year’s raise and this year’s raise), layoffs will not be necessary.  We all suspect smoke and mirrors.  It will be interesting to see if that projection remains the same once newly-hired County Administrative Officer Greg Devereaux starts to work officially.
