iePolitics: For all of those who keep telling me you want to help . . .

Here’s your chance.  Actually, you have one of several chances.

There are several of us who want to fire our worker’s comp attorneys.  I have come to the conclusion worker’s comp attorneys are worse than ambulance chasers.  The whole process on both sides of the fence is filled with scam artists including the doctors, the attorneys (including county counsel and risk management), and investigators.  No one cares if there is an injured person or not; it’s all about racking up fees.  So we are looking for a worker’s comp attorney who is a real pit bull.  Does such an animal exists?  I’m beginning to think not but if anyone has a recommendation, there are several of us looking.

Second, there are also several of us looking for a good employment law attorney.  Although we’re still pursuing the class action suit, some of us have claims for retaliation and hostile work environment that are so egregious we want separate cases.  Again, we are looking at a pitbull who will eat Ruth Stringer and spit out those bleached locks.

And finally, for me personally, I’m at my wit’s end with my landlord who has locked me out of my property, taken almost everything I own, and is not cooperating with returning it.  He has no court order.  As a matter of fact he attempted to evict me and the case was dismissed.  It’s a long, convoluted story I would be happy to share with anyone who can give me some help with it, but it’s too long to write about here.  I tried to get the Sheriff’s Office involved and now I’m the one being threatened with arrest.  I’m not sure I’m allowed to say who so I’ll just say that  someone one the Fifth Floor tried to reason with the guy and he agreed to cooperate but then when I tried to get my stuff this past weekend he refused.

I have a lot of antiques, art, etc., and each time my landlord and his wife were at my house they would remark about some of it.  I would bet anything some of my pieces now grace their home.  Because of my recent financial situation I would have pawned or sold some of it but I couldn’t because he won’t let me have it.  He has also taken all my financial records, all my medications, all my computer equipment, all my clothing, furniture, my Notary Public journal and seals, all my mom’s belongings, my brother’s shed and all his classic auto parts (he restores classic Mopars).  I could go on and on.  I don’t know how to get the Sheriff’s Department to do its job.  I contacted Hoops directly and he did nothing for me.

Again, anyone have any suggestions?

  1. Removing your notary public journal and seals is counter productive. Removing a way to earn some extra money to pay the landlord is a stupid idea.

Sounds like a wrongful eviction and your landlord has screwed up royally. You might hit the lottery for all these damages.

I hope for your success Sharon.

  2. As far as an employment law attorney my recommondation is Rees Lloyd. He practices out of Banning. The county (Riverside Co.?) Bar Association or the state Bar should have his phone number.

The least think this asshole (can I say that?) landlord can do (as required by law) is to allow you to get your personal property. I know understand why the sheriff didn’t help you. He’s responsible for either punitive damages for illegal eviction.

This may be trite info but If you know any attorney who can call the LL and explain he can be held liable for punitive damages, and is required to let you recoup your personal property.

If the eviction case fell out of court, you still have legal possession of the premises. I don’t understand why the sheriff is not helping. If someone is illegally locked out of their premises, they are suppose to intervene.

This isn’t much help; I wish I could help you with a ex parte restraining order. If you can get a paralegal do draft it (not a big deal), you can appear in pro per.

  3. Call Ed Palmer in Rialto… rocks the house as an Unlawful Detainer attorney….

  4. Branson, Last year when you first told me about Rees I called him at least five or six times and he never returned my call. Any ideas on how to get him to do so.

  5. Conversion is the legal definition for taking or holding property that you do not have a right to have. It is short of theft and carrie civil liability. A simple lawyer letter usually does the trick. Another method is to have your friends call and kindly ask what is going on. Best to limit the number to one a day, maybe three on the first day so harassment is not an issue.

Do you have any friends who are landlords and can talk to this guy on par?

I have an old customer who is a workman’s comp attorney in Orange County. I remember where she lives but not her name. I’ll look it up.

  6. Sorry about that, been there too. I gave a landlord a security deposit and paid him weekly for a room in a house he was renting out all 3 of the rooms. After collecting a week’s rent, he gave me a week’s notice. I was living paycheck to paycheck and lacked the money to move that quickly. Coming home from work I saw a note on the entry door to the house that said the locks were changed and my stuff was put in storage. To get a key to storage and my stuff I had to pay him his costs of moving and storing my stuff and some more money. Yeah right, I’m suppose to pay him extortion money and trust him to give me a key that is suppose to go to a lock on a storage unit that is suppose to contain my stuff. Law enforcement refused to intervene saying it was a civil matter. My stuff was stolen and the police claim it was not a crime. Whoever says law enforcement does not appeal to a**holes is a liar. By the time I got the money to hire a shyster lawyer and finally get him to have my ex-landlord served with papers he probably had already gotten rid of much of my stuff. I had to pay the shyster lawyer in full before he would accept my case then he tried to quickly settle for next to nothing. My ex-landlord got an expensive attorney, but still lost and ended paying me $4,000. I got back only about half of my stuff. I also got confirmation there are a lot of slime balls renting housing, in policing and in the liaryer field.
